Terms of service

The terms on which Serviciing is provided. Plain language where possible, because terms nobody reads protect nobody.

1. The agreement

These terms are between Arsaviva Technologies Private Limited and the business subscribing to Serviciing. Using the product means accepting them.

2. Subscription and billing

Serviciing is sold as a subscription per service centre location. [REVIEW: state your billing cycle, renewal terms, notice period and refund position.]

3. Acceptable use

You may use Serviciing to communicate with vehicle owners who have an existing service relationship with your business. You may not use it to message purchased contact lists, send promotional broadcasts unrelated to a service event, or contact anyone who has opted out. We may suspend an account being used this way.

4. Your data

You own your customer and vehicle records. We claim no ownership over them and process them only to provide the service. You may export them at any time.

5. Availability

We aim to keep Serviciing available at all times but do not guarantee uninterrupted service. Planned maintenance will be notified in advance where practical. [REVIEW: add an uptime commitment if you intend to offer one.]

6. Message delivery

Messages are delivered through third-party platforms. We are not responsible for delays or failures caused by those platforms, by network operators, or by incorrect contact details in your data.

7. Liability

To the extent permitted by law, our total liability is limited to the fees you paid in the twelve months before the claim. We are not liable for indirect or consequential loss, including lost profits. [REVIEW with your lawyer.]

8. Cancellation

You may cancel in line with your subscription terms. On cancellation you keep the right to export your data, and we delete it on written request as set out in the privacy policy.

9. Governing law

These terms are governed by the laws of India, and the courts at Guwahati, Assam have exclusive jurisdiction. [REVIEW: confirm the correct jurisdiction.]
